malfunctioning. the story is coming up in a live report. >> did you see that coast area with temperatures in the 50s? temperatures are in the 80s to near 90 degrees and record high temperatures today. >> and i'm frances dinglasan. first reports of a bart delay and rest of your wednesday morning commute. thank you so much for starting your day with us. i'm kristen sze. >> i'm eric thomas. >> new details about operation anyplace tune star the pentagon's official name for the commando raid that killed osama bin laden. there is word this morning that navy seals went ahead with the raid even though they weren't sure that bin laden was there. janelle has more details. >> we heard the c.i.a. was only 60 to 80% that osama bin laden was in the compound even after months of preparing for this mission navy seals were well aware they may not find the al-qaeda leader at his home.

they are clarifying details when the navy seals found bin laden in an upstairs bedroom. he did not have a weapon but his wife rushed a navy seal. she was shot in the leg but survived. c.i.a. director leon panetta says the seals had a split second to make a decision. they killed bin laden and brought his body out into a u.s. military helicopter. they are going through the hard drives and dvds a lot of it in arabic hoping it will reveal critical information. >> the first thing they are looking for a plan we know that he went over attack plans including the 9/11 plans. >> white house leaders were aware of parts of operation but didn't know what went down when the navy seals went into the compound. they did not watch it live when bin laden was shot.

behind his knee. he fired seven shots at officer and even hit the headrest in the car. officer had some cuts from broken glass. jones is on parole for a conviction. >> police are investigating another sexual battery case. it happened in the mail room of unit one on on a dorm building. an 18-year-old woman says she was inappropriately touched by the man they describe the suspect as east indian 6'3" 150 pounds wearing a blue turbine and blue shirt. >> defense will present its case to the jury in the murder of chauncey bailey. the man accused of ordering the journalist. prosecution rested its case after six weeks oftestimony. bey's attorney says they will

call a few witnesses. school officials say they probably won't punish a first grader that unknowingly brought a handgun at school. officials say a teacher and a student both noticed the weapon when the youngster opened his backpack and begin taking out books. police took custody of the gun and they are confident the student didn't know the firearm was there. >> contra costa board of supervisors has unanimously approved a budget for the coming fiscal year that includes $46 million in cuts mainly for public safety. new cuts require the elimination of 138 positions. they include they positions are the probation department. 28 in the sheriff's department and 12 from the district attorney's office. the d.a. says the cuts could force him to reduce prosecution
